AI & Patents: Key considerations in the UAE

Artificial intelligence is transforming how businesses operate – but when it comes to protecting AI-driven innovation, the legal landscape can be less intuitive.

In the UAE, not all AI-related inventions automatically qualify for patent protection. The key often lies in how the invention is framed, rather than the technology itself.

Why AI patents can be challenging

Many AI products rely heavily on software, algorithms, and data models. Under UAE patent law, computer programs “as such” are excluded from patent protection. This means that an AI invention may face challenges if it appears to cover only abstract ideas, algorithms, or software without a clear technical application.

What improves patentability

AI inventions are more likely to be patentable in the UAE when they are presented as technical solutions to technical problems. This typically involves showing:

  • A real-world technical application
  • A measurable technical benefit (such as improved system performance, efficiency, or accuracy)
  • How AI is implemented within a broader technical system, rather than as standalone software

Timing matters

Public disclosures can affect patent rights. This includes:

  • Product demonstrations
  • Research publications
  • Investor presentations or marketing materials

While the UAE recognizes a 12-month grace period for certain disclosures made by the inventor, this does not always align with international filing strategies. Early planning is therefore essential, especially for businesses operating across multiple jurisdictions.

Practical filing considerations

Patent applications in the UAE must be filed in both Arabic and English. Accurate translation is particularly important for AI-related terminology, as language nuances can affect how the invention is interpreted during examination.

Beyond patents

For some AI innovations – especially those closely tied to software or algorithms – a patent may not always be the most effective form of protection. In certain cases, trade secrets, copyright, or a blended IP strategy may be more appropriate, depending on the nature of the technology and the business objectives.
