Galadari Advocates & Legal Consultants on the Benefits and Challenges of AI in Dispute Resolution

On 04 April 2024, Galadari’s Senior Counsel Sergejs Dilevka and Associate Dimitriy Mednikov were quoted by the Jus Mundi in an article titled “Generative AI and Dispute Resolution: The New Reality”. The article examines the use of artificial intelligence (AI) in dispute resolution, particularly in litigation and arbitration. The authors explore how large language models (LLMs) are used in legal services to automate routine tasks, assist with legal research, and reduce the workload of lawyers.

The article acknowledges that the use of AI in dispute resolution is not new, but highlights the significant advances made in recent years, particularly with the emergence of “generative” AI, which has the ability to generate human-like text. The authors use Damien Charlotin’s piece published in August 2023, “Large Language Models and the Future of Law”, to introduce a framework to illustrate how LLMs can be used in dispute resolution.

The article highlights how LLMs can help with things like preparing contracts and procedural documents based on precedents, which can be especially helpful for small and medium-sized firms that may not have a comprehensive in-house precedent library, and generating boilerplate language for judgments.

The authors acknowledge that AI-generated work must still be closely overseen by lawyers to ensure it meets the requisite legal standards and ethical norms. They also highlight the importance of compliance with regulations governing AI use, especially with regards to data security and privacy, and the confidentiality of data.

They conclude with a reminder that while the use of AI in dispute resolution is undoubtedly increasing, human lawyers retain ultimate responsibility for the end result. The authors urge lawyers to balance the innovative potential of AI tools with the timeless values of the legal profession, including diligence, confidentiality, and ethical integrity.
